For years, many workers who filed a timely renewal of their employment authorization document (EAD) could keep working after the card expired under an automatic extension. On October 14, 2026, USCIS published a final rule confirming that this practice has ended for certain categories.

What the rule does

According to its summary, DHS published an interim final rule on October 30, 2025 that amended its regulations to end the automatic extension of EAD validity for people who timely filed a renewal application in certain employment authorization categories. The final rule responds to public comments and reaffirms and finalizes the interim rule. It was effective on October 14, 2026. The rule describes its purpose as enhancing benefit integrity and prioritizing vetting and screening before a new period of employment authorization is granted.

Where the change sits in the regulations

The regulation on EAD validity and extensions is 8 C.F.R. § 274a.13. The interim rule added a new paragraph (e) to that section and changed the heading of paragraph (d). The rule's background explains that automatic extensions had been up to 180 days and were temporarily increased to as much as 540 days before the 2025 change. Workers should read the final rule and the current Form I-765 page to confirm whether their category is affected.

The risk of a gap

Without an automatic extension, a worker whose renewal is not decided before the card expires may have no valid work authorization for a period. Employers must reverify work authorization when the document expires. For noncitizens, unauthorized employment can have lasting immigration consequences: section 245(c) of the INA bars adjustment of status for many applicants who worked without authorization, with exceptions such as for immediate relatives of U.S. citizens.

Planning a renewal

Employers and ITIN issues

Employers have their own verification duties, discussed in the legal implications of hiring a worker without authorization. An ITIN is a tax number, not work authorization; see how ITINs relate to employment verification.

When a renewal stalls

If a renewal remains pending well beyond normal processing and the worker faces job loss, federal court may be an option. EAD mandamus for Form I-765 delays explains when a lawsuit to compel a decision makes sense. Applicants with pending green card cases should also review work authorization while an I-485 is pending.
